{"id":9564,"date":"2016-11-18T11:52:44","date_gmt":"2016-11-18T11:52:44","guid":{"rendered":"http:\/\/monaghan.ie\/environment\/?page_id=78"},"modified":"2025-08-22T13:38:57","modified_gmt":"2025-08-22T12:38:57","slug":"composting-and-food-waste","status":"publish","type":"page","link":"https:\/\/monaghan.ie\/environment\/composting-and-food-waste\/","title":{"rendered":"Waste Bye-Laws and the Reverse Register"},"content":{"rendered":"<p><strong>Waste Bye-Laws \u00a0<\/strong><\/p>\n<p>The County of Monaghan (Segregation, Storage and Presentation of Household and Commercial Waste) Bye-laws, 2019 \u00a0came into effect on 6<sup>th<\/sup> January 2020 and are designed to ensure that both household and commercial waste generated in County Monaghan \u00a0is \u00a0properly managed.<\/p>\n<p>To comply with the Bye-Laws, householders and owners of commercial properties need to demonstrate that they are managing their waste in a responsible and legal manner. \u00a0The Bye-Laws will apply to all households, apartments and commercial premises.<\/p>\n<p>In order to manage your waste correctly you need to be able to prove that:<\/p>\n<ul>\n<li>You have a contract in place with a permitted waste collection contractor (bin sharing is permitted for which proof of agreement is required);<\/li>\n<li>You can demonstrate regular use of an authorised waste facility.<\/li>\n<\/ul>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>Why do we need these Bye-Laws?<\/strong><\/p>\n<ul>\n<li>To help you manage waste in an environmentally acceptable manner.<\/li>\n<li>To ensure that waste is only given to a permitted door-to door waste collector or brought to an authorised waste facility.<\/li>\n<li>To ensure waste is correctly segregated, and recycled;<\/li>\n<li>To reduce illegal dumping and backyard burning.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong>Where Can I get a copy of the Bye Laws<\/strong><strong>. <\/strong><\/p>\n<p>Click here to view the bye-laws<strong><a href=\"https:\/\/monaghan.ie\/environment\/wp-content\/uploads\/sites\/11\/2025\/08\/Waste-Presentation-Bye-Laws-adopted-2019-002.pdf\" target=\"_blank\" rel=\"noopener\">\u00a0 \u00a0 Waste Presentation Bye Laws (PDF)<\/a><\/strong><\/p>\n<p>&nbsp;<\/p>\n<p><strong>What happens if I don\u2019t comply?<\/strong><\/p>\n<p>If you fail to comply with any of the requirements of the Bye-Laws, it may result in a Fixed Penalty Notice (Maximum \u20ac75) being issued by this Local Authority or a member of An Garda S\u00edoch\u00e1na. \u00a0It may also lead to a fine on conviction of up to \u20ac2,500.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>I have received a letter from Monaghan County Council requesting details on how I dispose of my waste. So what should I do next ? <\/strong><\/p>\n<p>Please go to the Monaghan County Council website\u00a0and complete the self-declaration link. The following information is required<\/p>\n<ul>\n<li>Your address and your contact details.<\/li>\n<li>Information relating to your authorised waste collector, if you have a kerbside waste collection service. Your waste collection service Customer ID number to be submitted as part of this required information.<\/li>\n<li>Details of the waste facility you use, if you bring your waste directly to an authorised waste facility. Receipts demonstrating regular use of the waste facility shall be submitted as part of this required information. The authorised waste facilities in the County are the Scotch Corner and Carrickmacross Recycling Centres.<\/li>\n<li>Details of bin-sharing agreement, if you share your bins with a neighbour or family member. Bin sharing is permitted for which a \u201cProof of Agreement\u201d form is required.\u00a0 These are available at :\u00a0 <strong><a href=\"https:\/\/monaghan.ie\/environment\/wp-content\/uploads\/sites\/11\/2025\/08\/BIN-SHARING-AGREEMENT-ENGLISH-002.doc\" target=\"_blank\" rel=\"noopener\">Bin Sharing Proof of Agreement (Word)<\/a> \/<\/strong> <strong><a href=\"https:\/\/monaghan.ie\/environment\/wp-content\/uploads\/sites\/11\/2025\/08\/BIN-SHARING-AGREEMENT-IRISH-002.doc\" target=\"_blank\" rel=\"noopener\">Bin Sharing Proof of Agreement As Gaeilge (Word)<\/a><\/strong><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>Alternatively, you can reply to the letter email the information to <a href=\"mailto:wastecollection@monaghancoco.ie\">wastecollection@monaghancoco.ie<\/a> or by post to the Environmental Services Department, Monaghan County Council, Civic Centre, Riverside Road, Carrickmacross, Co. Monaghan.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>Will my information be kept confidential?<\/strong><\/p>\n<p>Your data will be stored and processed in line with Monaghan County Council\u2019s Data Protection Guidelines under GDPR.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>What if I don\u2019t comply?<\/strong><\/p>\n<p>If you fail to comply with any of the requirements of the bye-laws it may result in a Fixed Penalty Notice (Maximum \u20ac75) being issued by Monaghan County Council or by a \u00a0member of An Garda S\u00edoch\u00e1na. AVOID A FINE BY STAYING WASTE COMPLIANT.<\/strong><\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>How can I check if a waste collector is authorised?<\/strong><\/p>\n<p>Authorised waste collectors have a waste collection permit, issued by the National Waste Collection Permit Office. \u00a0\u00a0To check if they have a valid waste collection permit, a householder needs to contact the National Waste Collection Permit Office on 057 9373710 or email\u00a0<a href=\"mailto:contactus@nwcpo.ie\">contactus@nwcpo.ie<\/a><\/p>\n<p><strong>Who are the authorised Waste Collectors in County Monaghan ?<\/strong><\/p>\n<p>The following waste collectors are authorised to collect waste from your property in County Monaghan.<\/p>\n<ul>\n<li>Blue Dolphin Environmental Ltd<\/li>\n<li>Mahony Environmental Cleansing Ltd<\/li>\n<li>Oxigen Environmental<\/li>\n<li>Starrus Eco Holdings Ltd<\/li>\n<\/ul>\n<p>It is the responsibility of the waste generator to ensure the waste collector they engage with is compliant. A person could be fined up to \u20ac3,000 for using an unauthorised waste collector.<\/p>\n<p><strong>What is the Reverse Register?<\/strong><\/p>\n<p>Section 34C of the Waste Management Act, 1996 (as amended), empowers local authorities to establish a register, often referred to as a\u00a0<strong>&#8220;reverse register&#8221;.<\/strong>\u00a0This register helps Monaghan County Council to identify households and commercial premises where waste collection or disposal might be non-compliant with the Act, ensuring proper waste management practices. Relevant persons, including waste collectors and facility operators, can be required to provide information for the register.
