{"id":2046,"date":"2025-12-01T14:54:24","date_gmt":"2025-12-01T14:54:24","guid":{"rendered":"https:\/\/monaghan.ie\/finance\/?page_id=2046"},"modified":"2026-01-07T09:39:25","modified_gmt":"2026-01-07T09:39:25","slug":"rates-waiver-scheme","status":"publish","type":"page","link":"https:\/\/monaghan.ie\/finance\/rates-waiver-scheme\/","title":{"rendered":"Rates Waiver Scheme"},"content":{"rendered":"<h3>Applications now open<\/h3>\n<h3><strong><a href=\"https:\/\/documents.monaghancoco.ie\/Forms\/RatesWaiverScheme\" target=\"_blank\" rel=\"noopener\">Online Application Form<\/a><\/strong><\/h3>\n<h3><\/h3>\n<h3><\/h3>\n<p>&nbsp;<\/p>\n<h3><strong>Eligibility:<\/strong><\/h3>\n<p>The Scheme will be available to:<\/p>\n<ul>\n<li>A newly established business.<\/li>\n<li>An existing business relocating or expanding from outside the County.<\/li>\n<li>An existing business\u00a0maintaining\u00a0current location and expanding into a new location and evidence must be produced confirming this.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>The Scheme\u00a0commences\u00a0from the 5th of January 2026 and is only applicable to<strong>\u00a0commercial properties that have been vacant for at least 12 calendar months<\/strong>\u00a0prior to occupation.<\/p>\n<p>&nbsp;<\/p>\n<p>The following prerequisites apply to the subject premises:<\/p>\n<ul>\n<li>There are no outstanding enforcement proceedings or monies due to the Council under the Planning &amp; Development Acts 2000-2014 or the Derelict Sites Act 1990.<\/li>\n<li>There are no outstanding or current commercial rates, or any other local authority charges owing on the subject premises\u00a0(including 20% vacancy rate).<\/li>\n<li>There are no outstanding or current commercial rates, or any other local authority charges owed by the applicant.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h3><strong>Qualifying Applicants<\/strong><\/h3>\n<p>No rates waiver will be granted without a properly completed\u00a0<strong><a href=\"https:\/\/monaghan.ie\/finance\/wp-content\/uploads\/sites\/10\/2026\/01\/WRF-BLANK1-mb-1.docx\" target=\"_blank\" rel=\"noopener\">Application for Waiver of Rates Form (WRF)<\/a>.<\/strong>\u00a0The Declaration Form must be accompanied with\u00a0appropriate evidence\u00a0of efforts made to let the property.<\/p>\n<p>&nbsp;<\/p>\n<p>The following requirements apply to all applicants:<\/p>\n<ul>\n<li>The applicant must be the owner or lessee of the subject premises.<\/li>\n<li>The applicant must sign up for Standing Order\u00a0or Direct Debit\u00a0payments of commercial rates\u00a0and any other charges due to the Council\u00a0for at least 12 months\u00a0following the waiver period.<\/li>\n<li>The application must be accompanied by a lease agreement (if applicable) OR a copy of the Land Registry entry showing ownership details.<\/li>\n<li>Failure to remain current on any charges including any outstanding charges on the property and\/or\u00a0applicant will result in the immediate cessation of the Scheme and the removal of supports.<\/li>\n<li>The applicant must make the council aware of any changes to the uses or any of the requirements\u00a0stated\u00a0above for the applicant which materially alter the original application.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h3><strong>Scheme Criteria<\/strong><\/h3>\n<ul>\n<li>12 months\u202fWaiver Scheme.<\/li>\n<li>100% waiver of rates for first 12 months of business trading up to a maximum of \u20ac10,000 annual rates (properties with an annual rates bill of greater than \u20ac10,000 will receive a waiver of a maximum of \u20ac10,000).<\/li>\n<li>Full rates (pro rata) are due for payment after the 12 month period.<\/li>\n<li>The unit must be commercially rated.<\/li>\n<li>Eligible businesses can only avail of the scheme once in a\u00a05 year\u00a0period,\u00a0with the exception of\u00a0an existing business expanding into a second or\u00a0subsequent\u00a0vacant property.<\/li>\n<li>Applicants who avail of this scheme will not be affected by cessation or revision of this scheme if it changes within the 12 month waiver period.<\/li>\n<\/ul>\n<p><strong>Please note that\u00a0eligible\u00a0properties\u00a0must be made available for inspection by Monaghan County Council\u00a0staff\u00a0on request<\/strong>.<\/p>\n<p><strong>No application will be considered without\u00a0completion of the\u00a0WRF Form\u00a0and\u00a0relevant\u00a0evidence.<\/strong><\/p>\n<p>&nbsp;<\/p>\n<h3><strong>Rate Waiver\u00a0Scheme\u00a02026\u00a0&#8211; Terms and Conditions of the Scheme<\/strong><\/h3>\n<p>&nbsp;<\/p>\n<ol>\n<li>The relevant property must be a commercially rated property in the Council\u2019s administrative area.<\/li>\n<li>Complete and submit the Application for Waiver of Rates form in a timely manner.<\/li>\n<li>The Rate Collector should be notified by the liable person at an early stage as it may be necessary for the Rate Collector to inspect the property, to certify any application submitted.<\/li>\n<li>The scheme shall apply for\u00a0a period of 12 months from\u00a0commencement\u00a0of trading, scheme\u00a0commencing\u00a05th\u00a0January 2026.<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<p>Section\u00a015\u00a0of the Local Government Rates &amp; Other Matters Act 2019\u00a0as amended by the Historic and Archaeological Heritage &amp; Miscellaneous Provisions Act 2023 and SI 349 of 2024 Local Government Waiver of Rates Regulations 2024<\/p>\n<p><a href=\"https:\/\/www.irishstatutebook.ie\/eli\/2019\/act\/24\/section\/15\/enacted\/en\/html#sec15\" target=\"_blank\" rel=\"noopener\">Local Government Rates and other Matters Act 2019, Section 15<\/a><\/p>\n<p><a href=\"https:\/\/www.irishstatutebook.ie\/eli\/2023\/act\/26\/\" target=\"_blank\" rel=\"noopener\">Historic and Archaeological Heritage and Miscellaneous Provisions Act 2023<\/a><\/p>\n<p><a href=\"https:\/\/www.irishstatutebook.ie\/eli\/2024\/si\/349\/made\/en\/print#:~:text=S.I.,Waiver%20of%20Rates%20Regulations%202024\" target=\"_blank\" rel=\"noopener\">S.I.
