{"id":18638,"date":"2025-09-09T16:21:15","date_gmt":"2025-09-09T15:21:15","guid":{"rendered":"https:\/\/monaghan.ie\/planning\/?page_id=18638"},"modified":"2025-09-16T15:05:07","modified_gmt":"2025-09-16T14:05:07","slug":"short-term-letting","status":"publish","type":"page","link":"https:\/\/monaghan.ie\/planning\/short-term-letting\/","title":{"rendered":"Short Term Letting"},"content":{"rendered":"<div class=\"clearfix text-formatted field field--name-field-intro-text field--type-text-long field--label-hidden field__item\">\n<p>Short-term letting\u2019 is defined as \u2018the use of a bedroom or bedrooms in a home as paid overnight guest accommodation for a continuous period of up to two weeks. The rules around short-term letting are based on regulations introduced in July 2019\u00a0and apply to Rent Pressure Zones.\u201d In June 2025, Rent Pressure Zones were extended to the entire country until 28 February 2026.<\/p>\n<\/div>\n<div class=\"field field--name-field-structured-content-section field--type-entity-reference-revisions field--label-hidden clearfix field__items\">\n<div class=\"field__item\">\n<div class=\"paragraph paragraph--type--para-text paragraph--view-mode--default\">\n<div class=\"clearfix text-formatted field field--name-field-text-content field--type-text-long field--label-hidden field__item\">\n<p>Where a house or apartment is a person\u2019s principal private residence, they will be permitted to rent out a room (or rooms) within their home for short-term letting without restriction (e.g. B&amp;B-type use) but will only be allowed to sub-let their entire house without planning permission on the short-term market for a cumulative period of 90 days or less annually.<\/p>\n<p>This requirement for planning permission only applies to homeowners in Rent Pressure Zones where residential accommodation is in high demand and where homeowners:<\/p>\n<ul>\n<li>Let out their entire home (principal private residence) for short-term lets of more than 90 days in total while they are away. (Your principal private residence is the place where you ordinarily live).<\/li>\n<li>Let out a second property for short-term lets.<\/li>\n<li>\n<h2><strong>Applying for planning permission<\/strong><\/h2>\n<p>For owners who wish to operate new short-term lettings, they should apply for planning permission.<\/p>\n<p>When making its decision on a planning application about short-term letting the planning authority will take a number of things into account, such as whether the area is experiencing high housing demand, high rent inflation and insufficient supply of housing.<\/p>\n<p>To apply for planning permission to use a property for short-term lettings the usual fees for \u2018change in use\u2019 of a building from residential to commercial apply, see below:<\/p>\n<p><img fetchpriority=\"high\" decoding=\"async\" src=\"https:\/\/www.meath.ie\/sites\/default\/files\/inline-images\/Short%20Term%20Lettings%20Table%202.jpg\" alt=\"Short Term Lettings Fees for Planning Permission\" width=\"619\" height=\"168\" data-entity-type=\"file\" data-entity-uuid=\"1dea1c55-814d-4333-a790-a98cfb44270e\" \/><\/p>\n<div class=\"clearfix text-formatted field field--name-field-text-content field--type-text-long field--label-hidden field__item\">\n<p><strong>What happens if I don\u2019t follow the regulations?<\/strong><\/p>\n<p>Under the\u00a0<a href=\"http:\/\/www.irishstatutebook.ie\/eli\/2000\/act\/30\/enacted\/en\/print\">Planning and Development Act 2000<\/a>\u00a0planning authorities can take legal action if a property does not have the required permission, or where terms of the permission have not been met.<\/p>\n<p>From 1 September 2022, property owners and websites that advertise short-term lets, will both be fined if the properties being advertised do not have the correct planning permission.<\/p>\n<\/div>\n<p><strong>What happens if I don\u2019t follow the regulations?<\/strong><\/p>\n<p>Under the\u00a0<a href=\"http:\/\/www.irishstatutebook.ie\/eli\/2000\/act\/30\/enacted\/en\/print\">Planning and Development Act 2000<\/a>\u00a0planning authorities can take legal action if a property does not have the required permission, or where terms of the permission have not been met.<\/p>\n<p>From 1 September 2022, property owners and websites that advertise short-term lets, will both be fined if the properties being advertised do not have the correct planning permission.<\/li>\n<li>\n<h2><strong>Exemptions from the planning permission requirements<\/strong><\/h2>\n<p>You do not have to apply for planning permission if:<\/p>\n<ul>\n<li>Your property already has planning permission to be used for tourism or short-term letting purposes.<\/li>\n<li>You rent your property out under the\u00a0<a href=\"https:\/\/www.citizensinformation.ie\/en\/housing\/owning_a_home\/home_owners\/rent_a_room_scheme.html\">rent-a-room scheme<\/a><\/li>\n<li>You are \u2018home-sharing\u2019. Home-sharing is where a homeowner rents a room or rooms in their principal private residence for short-term lets while they are also occupying it. (In this situation you can offer unlimited short-term lettings for less than 14 days at a time.)<\/li>\n<li>You rent out your entire principal private residence for short-term visitors for less than 90 days a year while you are temporarily away.<\/li>\n<\/ul>\n<p><img decoding=\"async\" src=\"https:\/\/www.meath.ie\/sites\/default\/files\/inline-images\/Short%20Term%20Lettings%20Table.jpg\" alt=\"Short Term Lettings\" width=\"582\" height=\"271\" data-entity-type=\"file\" data-entity-uuid=\"b8b52a25-a27e-4860-8a22-db594225e60c\" \/><\/p>\n<p>&nbsp;<\/li>\n<li>\n<h2><strong>Registering with the planning authority<\/strong><\/h2>\n<p>In certain situations where you may not need planning permission you will\u00a0<strong>need to register<\/strong>\u00a0with the planning authority to get an exemption from the requirement for planning permission. This applies if:<\/p>\n<ul>\n<li>You rent a room in your principal private residence for short-term lets over 14 days while you are also occupying it.<\/li>\n<li>You are going to be away from your principle private residence, and you want to let it out on a short-term basis, for less than 90 days in a calendar year.<\/li>\n<\/ul>\n<p>If you are offering short-term lettings in an RPZ area, but are exempt from the planning permission requirement, you still need to register with the local authority in order to avail of this exemption.<\/p>\n<p>There is no charge to register your short-term let with the Local Authority.<\/p>\n<p>You must complete the following forms and provide any additional documents needed and send them to your local authority within the required time limits.<\/p>\n<ul>\n<li><strong>Form 15 \u2013 Start of year notification form.<\/strong>\u00a0This form should be sent to your local authority within 4 weeks of the start of each year, and no later than 2 weeks before the first short-term let of the year for that property.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li><strong>Form 16 \u2013 90 day threshold notification form.<\/strong>\u00a0This should only be sent to your local authority if you are a homeowner temporarily away from your\u00a0home and reach the 90 day threshold during the year.
