target=\"_blank\" rel=\"noopener\"><strong>RZLT Draft Map Viewer<\/strong><\/a><\/p><p>This link will bring the viewer to a central set of co-ordinates in County Monaghan, via the OSI GeoHive RZLT feature and will display the land in scope along with the County Council administrative boundary.\u00a0 The person accessing the viewer will be able to zoom in and out and will be able to see the dataset for the whole of the State.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-32f7e96a elementor-repeater-item-none the following field names:-<\/p><ul><li>the Parcel ID<\/li><li>the CSO standard local authority classification;<\/li><li>the date added, where that date is not 1<sup>st<\/sup>January 2022;<\/li><li>The land use zoning;<\/li><li>The land use zoning description;<\/li><li>The GZT zoning;<\/li><li>The site area;<\/li><li>The status;<\/li><li>Whether it is a live site.<\/li><\/ul><p>\u00a0<\/p><p>Any interested\u00a0individuals or parties may make submissions in respect of land on the Draft Map as set out in detail below.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f51fa7d elementor-repeater-item-none elementor-repeater-item-none_hover elementor-widget Therefore, it is not necessary to make a submission to remove this type of residential property from the Map. These submissions can:-<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d47eed3 elementor-repeater-item-none elementor-repeater-item-none_hover elementor-widget elementor-widget-text-editor\" data-id=\"d47eed3\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ul><li>challenge the inclusion of particular lands on the Draft Map if the owner considers that those lands do not meet the criteria set out within the relevant\u00a0<strong><a href=\"https:\/\/data.oireachtas.ie\/ie\/oireachtas\/act\/2021\/45\/eng\/enacted\/a4521.pdf\" target=\"_blank\" rel=\"noopener\">legislation (PDF)<\/a><\/strong>;<\/li><li>challenge the date on which the land is considered to meet the relevant criteria and thus to be in scope;<\/li><li>request a change of zoning;<\/li><li>identify additional land which appears to meet the criteria and so may fall into scope and may be placed on the supplemental Map.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2b1f0cd elementor-repeater-item-none elementor-repeater-item-none_hover elementor-widget elementor-widget-text-editor\" data-id=\"2b1f0cd\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Any submission must clearly identify the site and outline what change (i.e. inclusion or exclusion of land on a local authority Map, or the date on which the site first met the criteria for inclusion on the Map) to the Residential Zoned Land Tax Mapping is being sought, as well as provide a justification for the change sought.<\/p><p>The submission must state the criteria set out in Section 653B of the Taxes Consolidation Act 1997 which is being relied upon in the submission for the land being in or out of scope. Please note the local authority may request proof of site ownership.<\/li><li>Information \/ matters which demonstrate that the land is not in scope for the tax, or that the date which the land was considered in-scope is not correct and should be changed.<\/li><li>Reference to criteria in Section 653B of the\u00a0<strong><a href=\"https:\/\/data.oireachtas.ie\/ie\/oireachtas\/act\/2021\/45\/eng\/enacted\/a4521.pdf\">Taxes Consolidation Act 1997 (PDF)<\/a><\/strong>\u00a0along with evidence for consideration by the local authority to support any claims regarding the serviced nature of the land or any exclusions which should be applied. These criteria must also be referenced if the submission seeks to include additional land on the Map.<\/li><li>Any justification for inclusion or exclusion of land, reference to the criteria in the legislation.<\/li><li>Where a land use zoning change is sought, why the change in zoning is in the interest of the proper planning and sustainable development of the area, as well as any other circumstances which the landowner may wish to bring to the local authority\u2019s attention. Third parties cannot make a submission in relation to zoning. A third party submission should include:-<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-74bb207e elementor-repeater-item-none elementor-repeater-item-none_hover elementor-widget elementor-widget-text-editor\" data-id=\"74bb207e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ul><li>Name and address of person making the submission<\/li><li>Information to identify the land \u2013 either a written description, an Eircode or a Map with the area outlined. Where the local authority cannot identify the land they may not be able to take the submission into account.<\/li><li>For land on the Map, matters which demonstrate that the land is not in scope for the tax, or that the date which the land was considered in-scope is not correct and should be changed.<\/li><li>If the land is not currently on the Draft Map, if the submission is recommending that it should be considered in scope for the tax<\/li><li>Reference to criteria in Section 653B of the\u00a0<strong><a href=\"https:\/\/data.oireachtas.ie\/ie\/oireachtas\/act\/2021\/45\/eng\/enacted\/a4521.pdf\">Taxes Consolidation Act 1997 (PDF)<\/a>\u00a0<\/strong>along with evidence for consideration by the local authority to support any claims regarding the serviced nature of the land or any exclusions which should be applied. This will be to request evidence as is necessary to prove their ownership of the site in accordance with Section 653D(4) of the Taxes Consolidation Act 1997, or request further information from the landowner in accordance with Section 653E(2) of the Taxes Consolidation Act 1997.<\/li><li>A local authority may, where it considers it necessary for the purposes of making the determination, within 21 days from the date referred to in Section 653D(1) of the Taxes Consolidation Act 1997, request further information from Irish Water, the Transport Infrastructure Ireland or from a person referred to in article 28 of the Planning and Development Regulations 2001 (as amended).<\/li><li>Please identify any parts of the submission which contain personal or commercially sensitive data which should not be published.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6f654f70 elementor-repeater-item-none elementor-repeater-item-none_hover elementor-widget elementor-widget-text-editor\" data-id=\"6f654f70\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>Valid submissions must be submitted to the Planning Section of Monaghan County Council<\/strong>\u00a0<strong>by 1<sup>st<\/sup>\u00a0January 2023.\u00a0<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-751c399a e-flex e-con-boxed elementor-repeater-item-default_padding elementor-repeater-item-none elementor-repeater-item-none_hover e-con e-parent\" data-id=\"751c399a\" data-element_type=\"container\" data-e-type=\"container\" data-settings=\"{&quot;ang_container_spacing_size&quot;:&quot;default_padding&quot;}\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-5bc62e8a elementor-repeater-item-none elementor-repeater-item-none_hover elementor-widget elementor-widget-heading\" data-id=\"5bc62e8a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Inclusion on Supplemental Map<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2f2f9fac elementor-repeater-item-none elementor-repeater-item-none_hover elementor-widget elementor-widget-text-editor\" data-id=\"2f2f9fac\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>A supplemental Map will be published on 1 May 2023 identifying additional land considered to be in scope as a result of a change of zoning, servicing, or where the local authority becomes aware of the fact that land which wasn\u2019t included on the Draft Map, may meet the criteria for being in scope, such as where this has been identified during submissions. The supplemental Map will also be placed on public display and open to submissions which may challenge the inclusion of additional land on the Map.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-783ec2e8 elementor-repeater-item-none elementor-repeater-item-none_hover elementor-widget elementor-widget-heading\" data-id=\"783ec2e8\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Appealing a Decision<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-71a8febd elementor-repeater-item-none elementor-repeater-item-none_hover elementor-widget elementor-widget-text-editor\" data-id=\"71a8febd\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>A landowner has until 1 May 2023 to appeal the local authority decision regarding submissions made in respect of the Draft Map to An Bord Plean\u00e1la and until 1 September 2023 to appeal the local authority decision regarding submissions in respect of the supplemental Map. Appeals must be made in writing setting out the grounds of appeal.\u00a0There are no provisions for a third party to appeal a local authority decision to retain or remove land from a Draft or supplemental Map.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-577cc22b elementor-repeater-item-none elementor-repeater-item-none_hover elementor-widget elementor-widget-heading\" data-id=\"577cc22b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Final Map of Lands in Scope for RZLT<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-37fd8171 elementor-repeater-item-none elementor-repeater-item-none_hover elementor-widget elementor-widget-text-editor\" data-id=\"37fd8171\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Land indicated as being within the scope of the RZLT on both the Draft and supplemental Maps, as amended to take into account the outcome of submissions made in respect of the land on these Maps, will be included on the final Map of land in scope for the tax that will be published on 1 December 2023. This land will be subject to the tax unless it is exempt as a residential property, as outlined above.<\/p><p><strong>Next Steps<\/strong><\/p><p>All written submissions will be evaluated and a written determination will be made regarding submissions by landowners. The key steps taken prior to publishing a final Map include, but are not limited to the following:-<\/p><p><strong>Draft Map<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-511116b8 elementor-repeater-item-none elementor-repeater-item-none_hover elementor-widget elementor-widget-text-editor\" data-id=\"511116b8\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ul><li>Submissions received in relation to the Draft Map will be published on the local authority website by 11<sup>th<\/sup>\u00a0January 2023. Personal data within the submission will be redacted, but the location of lands to which the submission relates will be published along with the grounds of the submission.<\/li><li>Where a landowner requests the exclusion of their site from the Draft Map on the basis that it does not meet the criteria for being in scope, or challenges the date from which land on the Map met this criteria, the landowner will be notified of the decision not later than 1<sup>st<\/sup>\u00a0April 2023.<\/li><li>An appeal of the decision on a landowner\u2019s submission on the Draft Map, must be lodged by the landowner with An Bord Plean\u00e1la by 1<sup>st<\/sup>\u00a0May 2023.<\/li><li>Where a person has requested the addition of a site to the Draft Map and it is considered that the site in respect of which submissions have been made or based on the information available to the local authority, constitute lands satisfying the relevant criteria, then these sites will be identified on a supplemental Map\u00a0of land in scope for the tax which will be published on 1<sup>st<\/sup>\u00a0May 2023.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-312f80fe elementor-repeater-item-none elementor-repeater-item-none_hover elementor-widget elementor-widget-text-editor\" data-id=\"312f80fe\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>Supplemental Map<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7ca78f5f elementor-repeater-item-none elementor-repeater-item-none_hover elementor-widget elementor-widget-text-editor\" data-id=\"7ca78f5f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ul><li>Submissions in respect of land identified on the supplemental Map only must be made by 1<sup>st<\/sup>\u00a0June 2023.<\/li><li>Submissions received in relation to the supplemental Map will be published on the local authority website by 11<sup>th<\/sup>\u00a0June 2023. Personal data within the submission will be redacted, but the location of lands to which the submission relates will be published along with the grounds of the submission.<\/li><li>Where a landowner requests the exclusion of their site from the supplemental Map on the basis that it does not meet the criteria for being in scope, or challenges the date from which land on the Map met this criteria, the landowner will be notified of the decision not later than 1<sup>st<\/sup>\u00a0August 2023.<\/li><li>An appeal of the decision on a landowner\u2019s submission on the Supplemental Map, must be lodged by the landowner with An Bord Plean\u00e1la by 1<sup>st<\/sup>\u00a0September 2023,<\/li><li>The local authority must, reflecting the outcome of any\u00a0appeals to the Board, any additions or exclusions to Maps on foot of determinations made in response to submissions made or changes in zoning, prepare and publish a final Map by 1<sup>st<\/sup> December 2023.Where a landowner has requested a change to the zoning of their land, the Local Authority shall evaluate the submission and consider whether to propose the making of a variation.
