Categories of exempted development are set out in the Planning and Development Regulations 2001, as amended. The purpose of exemption is to avoid restrictions on minor developments. An exemption may, however, be removed by a condition of a planning permission. All permissions pertaining to a site should be reviewed before proceeding with any minor works.<\/p>\n<h3>Declarations on Exempted Development<\/h3>\n<p>In accordance with\u00a0<strong><u><a href=\"http:\/\/www.irishstatutebook.ie\/2000\/en\/act\/pub\/0030\/sec0005.html\">Section 5 of\u00a0Planning and Development Act, 2000<\/a><\/u><\/strong>\u00a0any person on payment of the fee (\u20ac80.00) may request a declaration as to whether development is exempted from requirement for planning permission or not.<\/p>\n<h4>To request a Section 5 Declaration:<\/h4>\n<ul>\n<li>Submit the request in writing, preferably using the Exempt Development Application Form below, to <a href=\"mailto:planning@monaghancoco.ie\"><strong>planning@monaghancoco.ie<\/strong><\/a> or post to Planning, Monaghan County Council, 1 Dublin Street, Monaghan H18 X982<\/li>\n<li>Include the appropriate fee (currently \u20ac80)<\/li>\n<li>A detailed description of the proposal.<\/li>\n<li>Provide as much information as is required to enable an assessment of the matter.<\/li>\n<li>An applicant may be required to submit further information to enable the assessment and determination of the matter.<\/li>\n<li>If, following the issuing of a Section 5 Declaration by Monaghan County Council, you are dissatisfied with the Council\u2019s determination, you may on payment of a fee and within 4 weeks of the date of the declaration appeal the decision to the matter to An Bord Plean\u00e1la.<\/li>\n<li><a href=\"https:\/\/monaghan.ie\/planning\/wp-content\/uploads\/sites\/4\/2024\/11\/Exempted-Development-Application-Form-Section-5-Revised.doc\" target=\"_blank\" rel=\"noopener\"><strong>Exempted Development Application Form &#8211; Section 5 (Word Doc)<\/strong><\/a><\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>What is exempted development?
