Data Subject Notification

Background

The purpose of this notification is to set out some information regarding the collection and processing of your information by Monaghan County Council.  During the course of our activities, we will collect, store and process personal data from the following:

  • Applicants for International Protection (IP applicants)
  • Those with Refugee, Subsidiary Protection, or Permission to Remain status
  • Programme Refugees, and
  • Beneficiaries of Temporary Protection (BoTP)

Monaghan County Council is the data controller in respect of this data.

Monaghan County Council creates, collects and processes a significant amount of ‘personal data’ and ‘sensitive personal data’ in various multiple formats daily. Our commitment is to ensure that the personal data supplied is:

  • Obtained lawfully, fairly and in a transparent manner
  • Collected for only specified, explicit and legitimate purposes,
  • Adequate, relevant and limited to what is necessary for the purpose for which it was obtained,
  • Recorded, stored accurately and where necessary kept up to date,
  • Kept for no longer that is necessary, and, in a form, which permits identification of the data subject,
  • Processed in a manner that ensures the appropriate security of the personal data including protection against unauthorised or unlawful processing of the data.

What data we collect and process

The types of personal data that we will collect, and process may include:

  Full Name Full legal name of the individual, used for identification purposes.
Age* The individual’s age, used for demographic analysis and service suitability.
Gender Gender identity of the individual, used to ensure inclusive and tailored support.
Nationality* Country of origin or citizenship, used to understand cultural and legal needs.
Phone Number

 

Primary contact number for direct communication.
Email Address Email address for official correspondence and follow-ups.
Current Address Postal address for official correspondence and follow-ups.
Future Destination Address*

 

Planned or anticipated relocation address, if known, to facilitate continuity of support.
Preferred Language(s)*

 

The language primarily used for communication, ensuring clarity in service delivery.
Level of English Proficiency*

 

 

Assessment of English language skills to determine the need for language training or support services.
Religious Beliefs* Self-identified beliefs, used to accommodate cultural or religious needs and preferences (if voluntarily disclosed)
Sexual Orientation* Information about sexual orientation or relationships (if voluntarily disclosed) to ensure services are inclusive and respectful
Medical Needs* Medical conditions or health-related needs directly impacting accommodation or integration requirements (if voluntarily disclosed)
Integration Challenges*

 

Specific barriers faced by the individual in integrating into the community, such as:

legal, health, housing, social or educational challenges.

Additional Support Needs*

 

Tailored requirements for the individual, such as mobility aids, specialised services or counselling.

 

*Special Category data not sought by LAITs however may be Voluntarily disclosed. When disclosed the data will be processed in accordance with Article 9 (2) (g) of GDPR.

 

Why do we collect this personal data?

We collect and process this information in order to manage and administer the relationship between you and us for the purpose of social inclusion, integration and community engagement and the ability to independently navigate life in Ireland including access to services, education, training and employment.

 

Lawfulness of processing

We process this personal data

  • In the exercise of official authority vested in us as the controller.

 

The lawful basis for processing of personal data is necessary pursuant to Section 66 (3) of the Local Government Act and in accordance with Article 6 (1) (e ) of the GDPR as detailed below;

 

Article 6(1)(e) processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller;

 

The lawful basis for processing special category data is detailed in Article 9 (g) as follows:

Article 9 (2)(g) processing is necessary for reasons of substantial public interest, on the basis of Union or Member State law which shall be proportionate to the aim pursued, respect the essence of the right to data protection and provide for suitable and specific measures to safeguard the fundamental rights and the interests of the data subject

 

The lawful basis for processing of personal data by the Local Authority are as follows:

 

Local Government Act 2001

Section 66 (3)(a) Subject to this section, a local authority may take such measures, engage in such activities or do such things in accordance with law (including the incurring of expenditure) as it considers necessary or desirable to promote the interests of the local community.

 

Section 66 (3) (b) For the purposes of this section a measure, activity or thing is deemed to promote the interests of the local community if it promotes, directly or indirectly—

 

  • social inclusion or the social, environmental, recreational, cultural or community development, or
  • the general development including enterprise and economic development,

 

of the administrative area (or any part of it) of the local authority concerned or of the local community (or any group consisting of members of it).”

 

Sharing of Personal Data

We may share your Personal Data with selected third parties, including for example the Department of Justice, Home Affairs and Migration and other government agencies, where required to do so by law. We may also share your data with other Local Authorities, suppliers and other third parties who assist us in fulfilling our functions. How long do we hold your personal data

We will keep your information for no longer than is required in accordance with our Retention Policy.
